UPTY TERMS AND CONDITIONS 

The owner of the online store UPTY (hereinafter referred to as the online store) is Upty OÜ (registry code 14562256), located at Narva mnt 7, 10117 Harjumaa, Tallinn, Eesti.

The validity of selling contract, product and price information

Selling conditions apply to purchases of goods from the online store.

The prices of the products sold in the online store are indicated next to the products. In some cases shipping fee is added to the price.

The shipping cost depends on the location of the purchaser, shipping method and purchase amount. The shipping cost is displayed when the customer places the order.

All prices are in Euros (€).

Product information is provided in product listing in the online store.

Placing an order

Once a customer fills a shopping cart with favorite pieces, he/she will proceed to checkout to see a list of the items in pending order, along with a breakdown of the total cost. By clicking on “Go to Checkout” customer will be prompted to provide their payment information and confirm shipping information. Then to click on “Place Your Order” to submit a final order request.

Order can be paid securely via following payment methods provided by Maksekeskus AS:

  • Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Latvian bank links: Swedbank, SEB, Citadele and Luminor
  • Lithuanian bank links: Swedbank, SEB and Luminor
  • Visa / MasterCard credit card payments

    NB! When using a bank link payment confirm the order and then click on the ‘Return to merchant’ button.

    The personal data necessary for the execution of payments is transferred to authorized processor Maksekeskus AS. The contract enters into force when the amount payable is transferred to the bank account of the online store.

    If we cannot deliver the ordered goods due to stock running out or for any other reason, the purchaser will be informed as soon as possible and the money paid (including the shipping cost) will be refunded promptly, but no later than within 14 days of receiving the notification. Customer will be offered an option to return money in a gift card way. If the customer agrees then the Gift card will be released instead of money return to the bank account.

    Shipment

    Goods are shipped to the following countries: Estonia, Latvia, Lithuania.

    These options are available for receiving the order: DPD for Estonia and Omniva for Latvia, Lithuania. 

    The purchaser bears the shipping cost and the respective price information is displayed next to the shipping method.

    All shipments within Estonia, Latvia and Lithuania generally arrive at the destination specified by the purchaser within 3-8 business days of the date of entry into force of the contract of sale. We have the right to ship goods in up to 45 calendar days in exceptional cases.

    Right of withdrawal

    After receiving the order, the purchaser has the right to withdraw from the contract entered into with the e-store within 14 days.

    The right of withdrawal does not apply if the purchaser is a legal person.

    To exercise the 14-day right of withdrawal, you must not use the ordered goods in any way other than is necessary to ensure the nature, characteristics, and functioning of the goods in the same way you would be allowed to test the goods in an actual store.

    If the goods have been used for any purpose other than is necessary to ensure the nature, characteristics, and functioning of the goods, or if there are any signs of use or wear and tear, the online store has the right to lower the amount returned in accordance with the decrease in the value of the goods.

    To return the goods, you must contact Upty by e-mail (sales@upty.ee) and You will be provided with information needed for making the return. 

    If there was a shipping charge in the original purchase, then the original shipping charge will be returned to the customer bank account together with the refunded purchase value. 

    Refund items shipping to Upty must be paid by the customer. 

    Customer will be offered an option to return money in a gift card way. If the customer agrees then the Gift card will be released instead of money return to the bank account.

    The online store has the right to refuse to make a refund until the goods being returned are received or until the buyer has provided proof of returning the products, whichever occurs first.

    The online store has the right to withdraw from the sale and demand that the goods be returned by the purchaser if the marked price of the goods in the online store is significantly lower than the market price of the goods due to an error.

    Defective goods

    Two year claim period is not allowed since we sell second-hand clothes. 

    Selling with Upty

    Sending garments for realization through http://Upty.ee is treated as a donation.

    Seller hereby represent and warrant that (a) you have good and marketable title to each item of Property and have the right to sell the Property; (b) none of the Property is subject to any liens or other encumbrances; (c) the Property does not include stolen or counterfeit goods or goods that are illegal to sell; and (d) the Property does not infringe upon, misappropriate, or violate any trademark, copyright, or other intellectual property or other proprietary right of any third party, any state or federal law, or any administrative regulation.

    Clean Out bags acceptance process takes usually 2-3 weeks, in case of a big amount of bags in the warehouse process can take up to 5-6 weeks.

    Upty only accepts items that meet our strict acceptance standards. Upty may reject an item for any reason. Upty is not obligated to explain sellers the reasons for items not acceptance.

    Customers may choose to add Return Assurance for an additional fee for each Clean Out Bag you request. If Return Assurance is selected, Upty will return items that we do not accept / do not sell during a certain period. Return Assurance can be added only while Clean Out bag is ordered. If Return Assurance is not selected, any unaccepted or unsold items will immediately and irrevocably become Property of Upty and will not be returned. Upty reserves the right to sell unaccepted items to third-party textile recyclers without any obligation to compensate you for such unaccepted items. If you do not agree to the foregoing, please select Return Assurance or consider the foregoing prior to using our Clean Out service.

    All not accepted items without Return Assurance are recycled maximum after 2 months from the moment when Clean Out bag arrived to the warehouse.

    Listing prices are settled by Upty employees using inner guidelines. Prices are determined by many factors, including the estimated retail price, brand, seasonality, and quality of each item.

    Once your item is listed, You can contact Upty team with the request to change item price during 48 hours after listing went online. You may not, at any time, increase or decrease the price more than 50% of the estimated retail price set by Upty.

    Payout for sold items is initiated the next month after the month when item was sold. Example: item is sold in January, payout will be done not later than on 20th of February. Your payout will be based on the final selling price, taking into account applied discounts. Percent for payout calculation is dependent on Full price settled for the garment. More information about the payout system can be found in Seller’s Terms.

    Direct marketing and processing of personal data

    The online store only uses the personal data entered by the purchaser for processing the order and sending goods to the purchaser. The online store forwards personal data to the transport service provider in order to deliver the goods.

    The online store sends newsletters and offers to the purchaser’s e-mail address only if the purchaser has expressed their wish to receive them by entering their email address on the website and indicating their desire to receive direct mail.

    The purchaser is able to opt-out of offers and newsletters sent to their email address at any time by letting us know via email or by following the instructions in an email containing an offer.

    Settlement of disputes

    All complaints made by a purchaser about the online store must be e-mailed to notices@upty.ee

    If the purchaser and the online store are not able to settle the dispute by agreement, the purchaser may contact the Consumer Dispute Committee. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a purchaser and the online store. The resolution of disputes by the Consumer Dispute Committee is free of charge for the purchaser.

    A purchaser may also turn to the dispute resolution bodies of the European Union.
